Hi,
I have a question and would really appreciate if some one can provide guidance.
My brother (currently in USA) got his H1B approved and he plans to go to US embassy in Ottawa to get the visa. We know that the H1B visa can take days to get approved due to administrative processing; therefore, he plans to give the interview to the US embassy and then leave for Pakistan.
My question is that in how many days my bro has to go back again to US embassy in Ottawa to collect his visa after the embassy informs him that his visa is back from administrative processing and is ready for stamping.
For example lets say my BRO gives the interview to US embassy on 2nd Dec. and then leaves for Pakistan on 4th Dec (since the actual time of administrative processing is unknown) and now lets say on 15 Dec. the US embassy informs him that his visa is ready and he can come for stamping (collect). So now in how many days my brother has to report to the embassy to get his visa stamp on his passport?
Does any have any idea about it !!!!

Regardless of whether everyone gets their Green Cards or not, the numbers should definitely see a substantial jump.
we are entering into the last quarter, where according to the new rules, everything that has not been allocated will be opened up for retrogressed categories for that FY.
Which actually explained why they pushed EB2 so far back, so that they can bring it forward in the last quarter, i.e. the July bulletin.
On the whole issue of EB retrogression, This current batch of EB based green cards have waited the longest number of years in the history of green cards.
So, sooner or later, someone in the goverment will have to answer why is that they let so many people apply green cards when they did not have a numbers solution ready.
Why were we even allowed to file for Green Cards when they could only issue a certain number based on the Country of Birth, each year.
This is like sell a product to someone, send him an invoice, and he comes back and says, sorry, we have a country wise quota, so even if we bought these goods from you, we wont pay you cos the quota for this year is up.
No, literally, export quotas work that way, they put a quota on sourcing, not on payments.
Why not do the same on Green Cards?
So, this whole mess, what is the right amount of time (in years), that it starts turning into a 'rights' issue from a 'flawed process' issue.
Currently, unless we have some representative in the government, who sees this flaw as a real issue, it is only us non-immigrants who can push this harder, and generate that representative, who instead of sliding this issue along with some big Financial bill, lobbies hard to get this issue resolved, as a separate entity..
ON the hope that OP has generated, personally, Am I hopeful, that I will get my Green Card in July.

The I-140 processing date for EB2 Nebraska is June 2007. I have a friend with receipt dt on July 30, 2007 in EB2 whose I-140 was approved today. My I-140

I came to USA with F1 as of last year and this year before completing i got approved for my H1 visa as stated by my consulatant and for which i had to be on status hence i continued my MBA and now this is my final semester and i will be done and my visa on F1 is valid till march 2008 . When i spoke to my consultant she told me tat its approved ie , my H1 but it will take another month for me to resolve it . So even if i get a job i have to still work without pay . Now i guess im dependent on her tat she should market me and get me a job . My bad luk that im stuck with getting H1 approved and no job though im through a consultant . Next thing is that i also completed my MBA and now if i was on F1 i could have got my OPT , but i guess now since my H1 is approved i have to wait to be marketed and also the query to be solved . So what will you guys suggest me ???

To the OP, I have a suggestion for you. Please try this in very good earnest.
Imagine in your mind, all through the weekend that your approval will come on Monday. Your priority date is current. You exhausted all options. You are very close. Maybe the IO has picked ur file & gone on vacation...maybe he will come back this weekend & just send an approval on monday. You have paid ur dues...u r very close....just relax. On renewing EAD & AP....just go ahead renew them...that will send another trigger for approval.
But the bottomline is - just imagine that u have already gotten ur approval.
Forget browsing immigration forums...forget logging into USCIS...forget about 'GETTING' the GC....just imagine that u 'ALREADY GOT IT'.
It makes a huge difference. trust me.

If your spouse is on H4, you can invoke the EAD? I dont understand what is the problem in invoking the EAD?

Hi all, my first post here. The forum has been truly useful so far and I'm glad to join today. I was one of those just lurking around but now I really need the feedback from D70 experts here since my 6 month old D70 won't work anymore overnight. I just put it back in the shock-proof case and it slept there, next morning it was no longer usable.
It seems like it's resetting constantly by itself. The MENU key shows the menu briefly and disappears, the last picture review button shows the last picture on the flash card briefly and also disappears.
When there's a card in it blinks the green light about once a second. Seems like it's really rebooting every second.
There is no display on the control LCD near the on/off switch. It is blank and does not show any traces of anything, just plain blank.
On the big LCD preview screen it is normally blank but like I said it does briefly display the last picture taken when you press review, but then disappears also at 1 second interval.
When the menu shows briefly after pressing MENU the movement keys do not affect the selection, all keys seem disabled during that brief period of time.
I've changed batteries, lenses, pushed every button and checked the lens socket connectors to see if anything looked strange - everything seems ok here. Tested the same batteries on another D70 and worked perfect just this morning.
It has taken no shocks or beating. It's a brand new D70 (6 months and a few days) and my retailer denies me warranty after 6 months - Murphy's Law applied to warranties says your equipment will break exactly after the warranty voids. I feel like I've been ripped off buying a refurbished piece for the price of a new one...but that's for another discussion.
I've written Nikon a few minutes ago but in the meantime I'd like to know if anyone here knows of a "keylock" switch or something that could disallow me access to the camera. Or could be a stuck reset switch or something like that. The menu shows and the internal mechanism is ok because it can read the last photo and displays readable stuff. The reset on the bottom of the camera does not seem ot reset anything, it just blanks the screen out briefly but then it goes back into an infinite reboot loop.
Help please!

finally status for EAD and AP changed to " documents mailed".
But yesterday i received a letter from USCIS related to the fax I did before.
and as per that letter, my request to expedite my EAD and AP is not valid(?????????????) so they sent my fax back (print out). I really dont understand this!!!!!!!!!!
waiting for EAD & AP hopefully I will get it tomorrow.

Hi,
My wife's I-485 is currently pending. Along with the I-485, an I-131, and I-765application was filed on July 31, 2007. As you know, the process time frame for the I-131 is 90 days. The I-131 was being a bit delayed due to the amount of fillings from the new fee increases. Over 120 days later in mid Dec. I still had not received confirmation.
Unfortunately, I just purchased tickets to travel overseas to visit family and friends for after Christmas. I emailed my immigration lawyer about the status and they only said that it's still pending.
Over a period of a few days my wife and I contacted USCIS to check on the status, and we found out that there was an error on her date of birth. That very day the date of birth was corrected and the I-131 was expedited and we received the documents in time to travel a few days later.
The immigration lawyer says that the error in the date of birth had little to none effect on why the I-130 was delayed. Instead he believes the delay was because he didn't receive tax documents from me till Dec. 4., which he believes is why the I-130 and I-765 was approved on the same day.
However, I asked for a fee reduction due to his lack of service. Due I have a valid argument? Any thoughts welcomed!

Hello,
I have an unfortunate situation. My parents names are misspelled in the Birth certificate compared to the Passport parents name page. Do we need to submit the parents names page of the passport when we submit our documents for 485 ?? Please let me know if this will be a problem and if there is a work around for this ??
Also if I have a Birth certificate (with my actual full name - dated in 2007 though), do I need to submit the affidavits ??

It would be better to get affidavits from your parents ,if u submit without affidavits u might get a RFE and this might delaying your process.

It would be better to get affidavits from your parents ,if u submit without affidavits u might get a RFE and this might delaying your process.

I spoke to one lawyer and he said I can respond to I-140 RFE myself if I know wht it is about.
If USCIS allows one to port I-1485 and approvable I-140 I am not sure what is all this mess about?

I did that too 2 months ago. FOIA/PA processing is "super" backlogged. I got a letter stating it's complex type !
I called up customer support number and gave them the control number , they said it's in 79K position in a 86K queue ! They process 5-6K every month !! Do the math.

not a redundant mail..just their process.
I got the CPO email on Oct 22, a welcome notice in my email on oct 24, actual welcome notices in my snail mail on oct 27 and the actual cards on Oct 30...so it took me 8 to 9 days to get the physical cards.
I'd say wait till you get the cards in your hand before you travel if you can..it's a different feeling :)
