Had a quick question. Not sure if this has been discussed before. Planning to get wife here on H4 and she wants to study. I have applied for 485 and in retro now. Is it advisable to study on H4 or F1? I know she can work on F1 but would that not be advisable since lets say the VB does become current in future for me then filing her 485 might be a problem since F1 is pure non immigrant and USCIS might hold it againt her. Any info/simlar situations greatly appreciated.

You can only work on an F1 under OPT which can only be applied for after at least two full semesters of studying or after graduation.
The F1 is not purely a non immigrant visa since this is the one people like my son are transferring to since they aged out of the employment based immigration system. If it were this would not be possible.
An H4 is as good as any choice if she plans to study. The fees will depend entirely on the state and the educational institution she chooses to attend.

Thanks. It seems I can not extend my J1 (Research Scholar) visa after getting the HRR waiver. Is anyobe aware of any foreign travel restrictions on a valid J1 visa with a granted HRR waiver?

Absolutely no problem. (assuming you visit is not very long - greater than six months and your GC gets approved as soon as you leave).
You can return using your AP as some suggest. Be mindful not to show any non-immigrant visa ( H1, L1, B1 etc.) as that might be construed as abandoning LPR status. If you do not have a GC, some have been given deferred inspection (to prove your status in a local USCIS office at a later date). Another option is for someone to collect your GC and mail it with a reliable service abroad (FedEX etc.) - in anticipation of some disagreement, this is perfectly legal - it is not a passport and is a entry document not a departure doc.

Th I-140 is not revoked yet, but the original company that filed it is going to split in to 2 separate companies by the end of the year and I think I-140 will become invalid after that right if the original company doesnt exist anymore??
You can still claim the PD of your old I-140. Once an I-140 is approved PD is yours to keep for life.

How familiar are you with creating apps in Blend? If you are not very familiar, I would strongly suggest looking through the tutorials found in the Basics / Overview section: http://www.kirupa.com/windowsphone/index.htm
They should provide you with a basic understanding of how to add controls to your project, make some tweaks to them, etc.

Just by having papers or reco letters is not good enough for NIW. Infact NIW is made tougher in recent times. Proving that work is in national interest in the most difficult part and cases are rejected due to this reason. If you are from India NIW would only save you couple of months of PERM work. EB2 is retrogressed. NIW was useful when labor certifications used to take sevaral years. If you are from india and you think you are really extraordinary and exceptional in your field, then go EB1. It is current now.if you have to apply in EB2 only then use the perm process. It is fast now.

EB3 is an overloaded ship, either you had to abandon(read porting to Eb2) or unload few of them (removing 245(i) cases from Eb3) to reach the target.
Abandoning can take an year for most of us - PERM Approval time line for now.
Unloading will never happen in this economic scenario
So we had to look for lifeboat saving to do the miracle. If any one finds it let me know am ready to grab it.

USCIS is one of the most greedy & inefficient organization. People in high offices should complaint about USCIS's Lie which their officials tells the congress all the time for adjudication delays. On one hand they say they are overwhelmed with too many applications, on the other hand they still issue 1 year advance parole, selectively 2 years EAD. They could easily make these documents valid for atleast 2 years, and have just one document for EAD & AP, but since they love to be overwhelmed with applications as they come the checks, they don't mind...

I think you get AP in out of Country when you are applying.
I'm in same boat as you couple of months of back and i canceled my trip as I got advise from Expert (Attorney) that AP's approved when out of country are not valid.

1. The short answer is: Yes, you can most likely accept a one year intra-company transfer to India, and then transfer back to a position in the US with Company B without necessarily lengthening your GC process.
2. BUT, in order to file for AOS based on the existing approved LC/I-140 (EB2 or EB3??), you would have to return to the US to work in the same position at the same location for which the underlying LC was approved.
3. Alternatively, if your position in India meets the USCIS definition of managerial or executive, and you transfer back to the US to take on a position that also qualifies as managerial or executive, Compny B could file an EB1 I-140 on your behalf (maintaining the priority date of the prior I-140), thus substantially shortening or eliminating the quota wait.
4. If you cannot qualify in the EB1 category, and Company B transfers you back to a new position or new location in the US. You can retain your original priority date, but the company will have to apply for a new PERM LC and then file a new I-140 for you.
[NOTE: The above analysis assumes you (and your spouse, if any) were born in India and subject to the immigrant visa quota for India.]
