Hi,
I need some clarification/suggestion regarding my status.
I came to US on F1 and am currently working on H1-B (never got H1 stamping) and I got married here in US. I applied for 485 as dependant with my spouse and I got my EAD/AP. I am still continuing on my H1-B without using EAD. We are planning to go to India in Dec and I prefer to use my AP while entering US and would like to continue working on my H1 (continue with same employer) after coming back. Is it possible and valid to do like that? If its ok, do I need to submit any form or anything to USCIS informing that. I prefer not to use EAD. Hope I am clear explaining my situation. Please suggest.

Short answer: No.
However, that said, you could have multiple H1 visas and work full-time for one and part-time for the other, as long as the first one doesn't have a problem with it :-)
If you get paid for work in the home country, there may be complications. One being that you'll still be taxed in the US. Consult a good Immigration attorney and a good CPA before doing anything like this.

Please note that an I-485 approval invalidates the H-1B visa.
I would travel to the US before Advanced Parole expiry to obtain the GC and return. I am not sure of any exceptions - please post the question in 'Ask a Lawyer' section ASAP.

Hello All,
I am planning to start working for a new company starting June. I was wondering If I can start H1B visa transfer to the new company via premium processing(hopefully will get approved in 2-3 weeks) and continue to work for the current employer and get paid till the end of May, even the though the transfer would have been approved in the end of April.

yes it can happen....
my case: we both filed under premium for our 7th year extension last year and hubby was processed in 5 days, but my H4 took 5 months together with RFE. RFE was stupid enough, they asked to see a copy of already approved H1 7th year.
My advice, wait and see what happens....
Sometimes they pick up H4 a week or so after h1. Good luck.

My H1B extension was approved for only 6 months, based on the SOW (Client Contract) end date (rather than the usual 3 year extension).
I would be just about in my maternity leave for the pregnancy during the petition expiry and if my further extension is denied (god forbid), I was told that I would be terminated from my employers' payroll and I have to leave the country or change my status to Student, Visitor etc.
FYI: I'm working for this company since Oct 2005.
Is there any law that prohibits termination of a worker during her PREGNANCY DISABILITY LEAVE (MATERNITY LEAVE) Or FMLA (Family and Medical Leave) on the basis that the USCIS didn't approve the petition (god forbid)?

That should be straightforward to do using buttons and a scrollviewer. The two buttons would be for the Left and Right arrows, and the scrollviewer would be the parent container for your images.

if you get fellowship, you dont have to work. TA/RA has to work, which needs authorization. Just for taking classes should be ok...disclaimer applies :)

Can anyone please tell, can the employee be trained by the employee before activation of visa i.e. 1st of October. The employer is not paying employee any wages for his training. Can his training be legal ? Is he allowed to sign any documents on behalf of the company during this training ?

i submitted my 485 one month ago but still haven't got receipt. I just got a new job offer from a big company, which i really dont want to reject. if i transfer my h1b now, will be 485 get rejected immediately? or my h1b transfer will be rejected? thanks for your advice!
