I applied for H1B as a Software Test Engineer and my LCA is applied with the same job description. Now i wish to work as Programmer Analyst in the same location specified in the LCA. will i need to amend my LCA or H1B or is it fine to continue with the same LCA. Are there any chances of my LCA getting denied and how long will it take to get the new LCA. Thanking you in advance.

Thanks for the reply. What I understand even there is no position for EB2 currently, EB2 can be filed for future employment.

Due to the statutory calculation method (explained more fully by USCIS and DOS on their websites), USCIS�s failure to timely process a sufficient number of applications resulted in the loss of approximately 349,000 visa numbers that could not be used in future years since the law prevents usage in future years. However, approximately 219,000 numbers have not been �recaptured�. The current worldwide pending cases in all employment based categories is approximately 340,000 applicants. I am on L1 B visa . I got visa for 3 years. I am working in usa. my I-94 expiration date is september 2009.

In regard to the background question, I'm assuming you mean the faint overlapping designs behind the contents in the header. This can be achieved by placing designs of your choice (such as the logo in the example you provided) on separate layers and assiging various opacities to each layer in photoshop (check the layers tab for the opacity modifier).
As far as making professional sites go: it's a pretty general question. I could only suggest practicing and learning from experience. Or go to a reputable design school.

Graham: DREAM Act push damaged wider immigration reform effort
Sen. Lindsey Graham (R-S.C.) said Saturday that the failed Democratic effort to pass the DREAM Act in the lame duck session dealt a blow to future talks on a wider immigration bill.
�It was an exercise to try and taint Republicans with Hispanic voters, knowing that the DREAM Act under these circumstances could never pass,� Graham told reporters in the Capitol after the bill sputtered on the floor.
�What they have done on the DREAM Act is hurt overall comprehensive immigration reform,� he said.
The DREAM Act, which would give legal status to illegal immigrants who came to the country at a young age, lived here for at least five years, graduated from high school and attended college or served in the military, fell five votes short of the 60 needed to overcome a GOP-led filibuster � 55 to 41.
Graham has worked with Sen. Chuck Schumer (D-N.Y.) in the past to try and seek a Capitol Hill compromise on a wider reform plan -- one that would blend increased enforcement and border security with a path to citizenship for undocumented immigrants, among other measures.
He said the DREAM Act effort will make it harder to bridge divides on immigration, noting the impassioned advocacy on both sides of the issue.
�Our base is all riled up that this is amnesty, so you have taken a debate on immigration, one part of it, you have gotten people emotional before you can sit down and reason your way through a comprehensive bill,� Graham said. �Doing this vote the way they did it has hurt the ability to do comprehensive reform next year to some extent.�
What Graham conveniently forgets is that he gave up on the immigration bill, because it was being taken up before the 2010 elections!

He can file the H4 extension based on the H1B extension application receipt...
Even if there is a RFE..that does not stop him from filing the H4 extension..Please tell him to file the H4 extension immediately....Usually you do not send a new application along with the answers of RFE..Just file it separately....After H1 goes through they would process the H4 too may be no at the same time but that should be fine....

To my knowledge H1B extension is just like a new H1B application ofcourse 6 years window will be couted here and you have spent just 3 years. To me you can file H1B extension with multiple companies. But its better to file it with original company to be on safe side, onece the extension approval come ytou can trasfer it whereever you want.

Just carrying a copy of the receipt is sufficient. Normally the officer will only be interested in the passport and original AP document - that was my experience recently coming into the country.

I think mom's in the forum can answer this better since i am sure many of them took short term disablity during delivery and subsequent months. My wife took it twice for the birth of our children and I dont think it is an issue.

My PD is 04/2002 and RD is 18/June/2007, EB3 India. EAD approved and fp done in Aug.
There are no soft LUDs on my 485 after 7/17/2007. What does this mean? Is there a way to check if I am stuck in name check?
I see many people with later RD and PD getting soft LUDs. Is anyone else in the same boat? Please advice..

Not getting a soft LUD is the norm. It just means your case was not an exception and you can't expect any miracles ..Yet! But Getting LUDs is not guaranteed to result in GC approval either. So please stop worrying about every little thing and enjoy your life... (Like I'm doing visiting this forum every now and then ;)

Hi all,
I have a simple problem but can't get an anwer at the consulate because the person who's name is on the website to call is unbelievably rude even when I was very polite in asking 2 questions and calling him 'sir' all the time :(
I got my renewed passport yesterday and it doesn't contain my husband's name in the spousal name areal. So the problem is this:
1. I have applied for an H4 visa and I sent a copy of that application along as they requested.
2. All my proofs of residence were based on my marriage as the utility bill is in his name so there could be no confusion about the fact that I am married and the name of my spouse.
3. My address in India has been stated as my husband's address already but his name is not on the passport - is this really a problem?
4. I don't want to face any trouble when traveling as I'll be on an H4 with a passport that doesn't have hubby's name on it.
My question is:
1. Do I need to send anything else to them other than my new passport, an attested copy of my marriage certificate, and a $20 check for the return express mail?
2. Does the Washington DC consulate have an email address where I can submit a query as the two people listed on the website to call for passport problems do not seem to want to talk to anyone?
3. Can I possibly call the Chicago or SFO consulates to ask my questions as they seem to be better people (my hubby and brother got theirs renewed in these places)?
